Terms of Service

Welcome to Lumo Pages! These Terms of Service (“Terms”) govern your access to and use of the Lumo Pages platform, including all associated services, features, and tools provided by Lumo Pages (“we,” “us,” or “our”). By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Platform.

1. Introduction and Acceptance of Terms

1.1. Agreement. By using the Platform, you acknowledge that you have read, understood, and agree to comply with these Terms, our Privacy Policy, and our Data Processing Agreement (DPA).

1.2. Applicability. These Terms apply to all users (visitors, registered users, and respondents). The Platform is not intended for individuals under 16 years of age.

2. Definitions

2.1. “Platform” means all services and tools provided by Lumo Pages for digital form and page creation.

2.2. “User Content” means any data, text, or files uploaded or managed by users.

2.3. “AI Services” means features powered by third-party engines (e.g., Google Gemini) to generate content or designs.

2.4. “AI Prompts” means textual inputs provided by you to the AI Services.

3. Account Registration and Security

3.1. Account Integrity. You must provide accurate information during registration. You are solely responsible for maintaining the confidentiality of your login credentials.

3.2. Unauthorized Access. Notify us immediately at [email protected] if you suspect a security breach.

3.3. Marketing communications. During registration you may optionally opt in to receive product updates, tips, and occasional promotional emails from Lumo Pages. Marketing communications are not required to use the Platform. If you opt in, you may unsubscribe at any time using the link in any marketing email. We may still send transactional or service-related messages (such as account verification, security alerts, or subscription notices) regardless of your marketing preferences.

4. Service Scope and Prohibited Content

4.1. Permissible Use. You may use the Platform for personal or business purposes in accordance with these Terms.

4.2. Strict prohibition on sensitive data. You (as Controller) are strictly prohibited from using the Platform to collect:

• Financial or payment credentials (credit card numbers, bank details).
• Passwords or login credentials for any service.
• Government-issued IDs or national identification numbers where prohibited by applicable law.
• Sensitive personal data (health, religious, or political information) without an explicit legal basis and appropriate safeguards.

4.3. AI content responsibility. AI-generated content is provided “as-is.” You must review and approve all AI output. Lumo Pages is not responsible for the accuracy or lawfulness of AI-generated content.

5. Subscription Plans and Payments

5.1. Plans. Access levels (Free, Plus, Pro) are subject to the storage and submission limits specified on our pricing page.

5.2. Payments. All payments are subject to the terms presented at checkout and our Refund Policy. We encourage you to evaluate the Platform on the Free plan before purchasing.

5.3. Automatic renewal. Subscriptions renew automatically unless canceled via account settings prior to the billing date, where applicable.

6. Intellectual Property

6.1. User ownership. You retain all rights to your User Content and AI Prompts.

6.2. Platform rights. Lumo Pages retains all rights, title, and interest in the Platform’s software, design, and intellectual property.

6.3. License to Lumo Pages. You grant us a non-exclusive, global license to host and process your content solely to provide the Services.

7. Indemnity and Limitation of Liability

7.1. Indemnification. You agree to indemnify Lumo Pages against claims arising from your User Content or violation of these Terms, to the extent permitted by law.

7.2. Liability cap. To the maximum extent permitted by law, Lumo Pages’ total liability for any claim shall not exceed the amount paid by you in the six (6) months preceding the event, if any.

7.3. Exclusions. Lumo Pages is not liable for indirect, incidental, or consequential damages, or for service interruptions due to third-party providers.

8. Termination

8.1. Breach. We may suspend or terminate accounts that violate these Terms or collect prohibited sensitive data.

8.2. Data deletion. Upon account termination, personal data is handled in accordance with our Privacy Policy.

9. Modifications to Terms

9.1. Right to modify. We may update these Terms at any time. We will update the effective date at the top of this page.

9.2. Continued use. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms where permitted by law.

10. Governing Law and Arbitration

10.1. Jurisdiction. These Terms are governed by the laws of the State of Israel.

10.2. Disputes. Any dispute that cannot be resolved informally may be subject to binding arbitration in Beer Sheva, Israel, under the Israeli Arbitration Law, in Hebrew or English, as described in the published Terms on lumopages.com.
